Time Limitations

One often overlooked consideration after a person has been injured in an accident is the legal time limit for filing an injury claim. This "statute of limitations" or other notice requirements are critical to pursuing an injury case and people frequently wait too long to hire a lawyer. Certain cases may be barred forever if proper notice is not given within 180 days of the event. Some lawsuits must be filed within one year of an event. Some circumstances require even shorter "notice" deadlines. The more time that elapses after an accident, the harder it is to piece together the evidence as well as shortening the time needed for investigation of the claim. The Need for Insurance

Yet we frequently tell our clients to give those very insurance companies more money to obtain the higher insurance coverage that they need. How It Works, A Case History:

We represented a woman who was involved in an accident which resulted in injuries that were serious but not disabling. That case was settled. After reviewing her insurance coverage, we recommended that she raise her coverage limits. She did increase her uninsured motorist coverage from $50,000 to $500,000. Uninsured motorist coverage is available from your own insurance company if you are involved in an accident with an uninsured driver, an all too common occurrence these days.

She was involved in a very serious accident several years later with an uninsured driver and suffered serious and disabling injuries which left her unable to work and tortured by the winter weather in Colorado. Fortunately, because she had increased her coverage, she was able to sue her own insurance company for $500,000 after they refused to settle her claim.

After successfully trying her case against her own insurance company, my client obtained a recovery that allowed her to relocate to Arizona with her husband and purchase a home. While her financial recovery could never take away her disabling injuries, it did allow her to have the financial means to live a life that was free from many of the difficulties she would otherwise have had to contend with for the rest of her life.

Wrongful Denial of Personal Income Disability Benefits

Income disability policies pay a wage replacement benefit if you are unable to work as the result of heath issues.
